Scope
These Terms govern the voluntary use of the browser game "GrimWallTD" (hereinafter "Game") provided by Kalemodo UG ("Provider"). They apply to all non-commercial users. Commercial use is excluded.
Description of the Game
The game is in an early, experimental phase and runs entirely in the browser. Core game features (progress, status) are stored locally. No user accounts, high scores or server-side player profiles are currently created.
Availability
The game is provided "as is". We may change, restrict or discontinue parts or all of the service at any time for technical, legal or economic reasons.
Support Payments (via Stripe)
We may offer voluntary support payments through our payment provider Stripe. These payments are optional, confer no in-game advantages and do not change the non-commercial nature of the game. Prices/currency are shown at checkout; processing and receipts are handled by Stripe under their terms. For issues contact us at grimwalltd@kalemodo.com. Payments are not required to use the game.
Intellectual Property
All content (code, text, graphics, design) is protected by copyright or other intellectual property rights. A simple, non-transferable right to use the game in your own browser for private entertainment purposes is granted. Reverse engineering (unless legally required) and automated scraping are prohibited.
User Conduct
It is prohibited to use the game abusively, circumvent security mechanisms, introduce malicious code, overload infrastructure, or exploit bugs for unfair advantages. Discovered bugs that could affect stability or fairness should be reported.
Warranty / Liability
The game is provided free of charge. There is no entitlement to uninterrupted or error-free availability. Liability for free services is limited to intent and gross negligence. Mandatory statutory liability (e.g. product liability) remains unaffected.
Privacy
Data processing is explained in the separate Privacy Policy. By using the game you confirm that you have taken note of this.
Changes to these Terms
We may adapt these Terms to legal, technical or gameplay developments. The current version is published on this page. Continued use after changes take effect constitutes acceptance.
Applicable Law
German law applies, excluding conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in the EU, mandatory protective provisions of the country of residence remain unaffected.
Severability
Should individual provisions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose.
